In Spain, ownership of land does not automatically include the right to build on it. Development rights derive from planning law and the municipal planning instruments that classify and regulate each plot. For investors, understanding classification is essential to valuing land correctly.
The main categories
- Urban land: land already integrated into the urban fabric, generally with services. Building may be possible subject to licence, though some plots require completion of urbanisation works.
- Developable land: land designated for future urban growth. Development usually requires approval of further planning and management instruments and the assumption of costs and cessions.
- Rustic land: land protected from urban development or not suitable for it. Building is generally very restricted and limited to specific permitted uses.
Planning instruments
Classification is set out in the municipal general plan and developed through more detailed instruments. Island-level and regional planning, as well as sectoral rules, can also constrain what a municipal plan allows. Investors should identify every instrument that applies to the plot, not only the general plan.
Buildability and use
Beyond classification, the detailed rules set permitted uses (residential, tourist, commercial), buildable area, height, occupation and setbacks. Two plots in the same classification can have very different value depending on these parameters.
Planning can change
Plans are revised, annulled by courts or suspended. A plot's development potential can therefore move in either direction over time. Investors should ask whether a plan revision is in progress and whether any instrument affecting the plot is under legal challenge.
Hypothetical scenario: the example below is invented for illustration. It does not describe any real property, project, company or person. Two investors compare neighbouring plots at the same price. One is consolidated urban land with a defined buildable area; the other is developable land awaiting a detailed plan, with obligations to cede land and fund infrastructure. On closer legal review, the apparently identical prices reflect very different risk and timing.
